We draft or review new leases to provide advice and assist the respective party to ensure the lease instrument accurately reflects agreements reached in the initial negotiations between the landlord and tenant.

We also advise parties on the commercial terms of the lease to help ensure it aligns with their needs and circumstances.

When a business is sold or an internal business re-organisation occurs, a transfer of assignment of lease is often required.

We assist landlords and tenants with all aspects of transfers of lease including due diligence and advice, liaising/ negotiating with the other party or their representative (including commercial agents) and preparing and/ or reviewing all relevant documents.

Drafting the renewal documents and attending to rent review/ market review as required. Liaising with tenant/ landlord’s representative on behalf of the client.

Advising and assisting client with lease variations including drafting variation documents and negotiating with other parties on behalf of the client.

A breach of lease can be a complex and time consuming matter, We assist clients to resolve leasing breaches on behalf of landlords and tenants including, if necessary, terminating the lease.

We assist clients with valid market rent reviews to establish the current annual market rental for the premise, in compliance with the lease and Retail Leases Act 2003 (Vic).

Advising client on status and options under the lease, preparing and issuing notice of breach of lease and assisting in respect of termination of lease as required.

Advising and assisting clients regarding tenant’s abandoned goods, and steps and legal processes to remove such goods as required.

Monitoring important milestones for landlord/ tenant regarding dates to exercise options, rent review and notices as required.
